When an employee causes harm to others and the employer should have known about the individuals potential for harm but did not take steps to limit the risk (i.e., not hiring the individual), the claim is known as negligent hiring. Businesses use stringent background checks as one method to prevent being held liable for irresponsible hiring. If an employer is found liable for negligent hiring, they may be required to pay damages to the victim of the employees negligence.
